Abstract

Regulations relating to non-farming cooperatives in accordance with the «Directives of Economic and Social Politics of the Party and the Revolution»—approved in the VI Congress of the Communist Party—were published in 2012 for the first time since the Revolution.

These decrees and rules, drafted in prevision of the future General Law on Cooperatives, represent an enormous move forward mainly because they allow for the formation of Cooperatives in sectors other than farming which will help find jobs for thousands of unemployed individuals whilst providing them with legal coverage, at the same time allowing the State to concentrate on the fundamental means for production. However, after analyzing the document and in light of other decrees and the General Law published by the ACI Americas, certain deficiencies may be observed, such as the continuous control by the State throughout all of the phases of the Cooperative's life. It is to be expected that these small deficiencies will be corrected in the future General Law, leaving the State to advertise and promote the Cooperatives and that the Members of the Cooperative be those whom take on more responsibility during both the Constitution Phase as well as throughout the life of the Cooperative.
