Abstract

Associated work cooperatives have the potential to create decent work and can be an alternative to work in a dependency relationship and individual self-employment, which deserves to be considered by states when applying measures that promote employment.

For this purpose, the Ecuadorian National Assembly has recently approved a bill to reform various regulatory bodies, including the Organic Law of Popular and Solidarity Economy. One of the objectives of the reform is to promote associated work cooperatives, firstly, by clarifying the nature of de relationship between the worker member and the cooperative, which is of a solidarity and non-labor nature, and secondly, by making visible the need to protect some rights of working partners. We must recognize the effort of the assemblyman to promote the cooperative sector, and specifically the associated work sector, however, I believe that there are important issues that could be better clarified, and others that were not dealt with despite their importance.

This article seeks to monitor the work associated in the Constitution and other regulations, both international and national, to clarify the nature of the relationship of the worker member with his cooperative, and towards the end, some notes are presented that could improve the guarantee of the rights that the reform seeks to protect.
