Abstract

In this essay I analyze the constitutional system set up from the moment of the crisis of the monarchy and the creation of the governmental Junta in 1810. Vagueness and unclearness characterizes such constitutional system: in contrast with other areas like Venezuela or Nueva Granada a constitution was not voted until 1819. In the meanwhile the country was ruled by provisional statutes that finally conformed the true system of government. The imaginary of the actors, mainly the members of the Congress, about the true meaning of an ideal constitution can partially explain the long-standing of this «provisiorato» system. However, when the constitution was promulgated in 1819 it was not able to resolve the main question about the subject of sovereignty and was refused by the towns and cities (pueblos).
