Abstract

Extrajudicial executions are a rooted phenomenon in state practice in various American countries. By reviewing the jurisprudential criteria issued by the Inter-American Court of Human Rights, this paper aims to expose the evolutionary path followed by the application of the parameters required to the States, in response of one of the most urgent serious human rights violations. With given attention that is frequency and results cast doubt on the institutional legitimacy that gives foundation to the democracies of the continent. Extrajudicial executions must be prevented, punished and eradicated; Inter-American jurisprudence is essential in this task.
