Abstract

This paper aims to analyse, from a legal and criminal perspective, the type of omission of the duty to prosecute crimes by public authorities or officials (Art. 408 of the Criminal Code), in relation to the delimitation of its typical scope. To this end, a distinction is made between the doctrinal treatment of this matter and the jurisprudential treatment, mainly promoted by the Supreme Court. In relation to the latter, it explains how the Supreme Court's adherence to one of the two existing doctrinal positions generates a distorting result at the penal level between the type of offence under Article 408 of the Criminal Code and those that punish the failure to prevent crimes (Articles 412.3 and 450 of the Criminal Code). In turn, as explained, this jurisprudential trend contributes to the criminal overprotection of members of the Judicial Police for acts carried out in their investigative work in relation to certain types of crimes.
