Abstract

This paper will analyse the judicial decisions that have been delivered in application of the minor offence of ‘street’ sexual harassment contained in article 173.4 of the Criminal Code since its entry into force. To do so, first of all, some brief introductory observations on the regulation will be made. However, the bulk of the work will be focused on examining the few judgments on the subject available in the main case law databases, which, despite their limitations, have allowed us to draw a couple of interesting conclusions. The first, in relation to the casuistry and the characteristics of those convicted and their victims that have been extracted from the reading of the proven facts in the rulings analysed; and the second, regarding the use of the offence to punish different and more serious types of sexual behaviour other than sexual harassment. All of this has been done by analysing the proven facts and legal grounds of the thirty-three decisions obtained from CENDOJ and Aranzadi selected because of their interest for this study, from 7 October 2022 to 31 July 2025.
