Abstract

The article analyzes the evolution of the Spanish penitentiary system from the beginning of the Franco time to the enactment of the General Penitentiary Organic Law that governs the system today.

The central theme is the novels "Walk or Bust" and "Tomorrow, I Will Be Free," written by jurist and writer Eleuterio Sánchez. These works introduce us to the Spanish penitentiary system and its legal evolution throughout the period to which they refer, beginning in the 1940s, passing through the Penitentiary Regulations of 1968, the subsequent penitentiary reform and democratization of the penitentiary system, and ending with the enactment of the Spanish Constitution and the approval of Organic Law 1/79, of September 26, the General Penitentiary Law.

The novels used in this article depict specific socioeconomic conditions within a very particular setting. Literary works offer a useful way to approach not only our recent past but also the diverse realities of the prison system at that time, with the perspective that history affords. This reflective exercise facilitates the analysis of criminal activity from a legal and social standpoint, the learning of potential strategies for reducing recidivism and promoting desistance from crime, and the optimization of prison treatment—key knowledge for the many disciplines operating within the current prison system: Law, Social Work, Sociology, Psychology, and various branches of Education.
