Abstract
The analysis of the lines of economic and social action developed in the context of the current global crisis, show the design of a new legal framework in which conventional collective bargaining unfolds. From this perspective, and based on the fact that collective bargaining is a cornerstone of the current system of labor relations, urges an analysis of the contents included gotten recent labor reforms in Spain that allows us to extract elements and criteria of judgment about whether or not to adopt a new standard, more decentralized and more close to the company. The legal option of the idea that the previous model has failed because it is not feasible at present and is slightly adjusted to reality, and has chosen to articulate a system in which there is that difference the structural from the cyclical, because the current economic climate requires to. That the reform process has ignored the social dialogue, has caused unrest and has revived the traditional dialectic between the legal and the conventional regime of collective bargaining.
