Abstract
In the institution of collective redundancies, two intrinsically related factors have a significant impact: age and work. The first element has a direct impact on the permanence of the worker in the company or group of companies affected by the collective redundancy and on the problem of discrimination on the grounds of age, with special attention to the criteria of the Court of Justice of the European Union. The special Social Security agreement constitutes a means of ensuring respect for the priority of permanence in favour of mature people. This figure requires certain changes in its current regulation, in order to offer a much more coordinated, efficient and systematised treatment.
