Abstract

Family foster care has had limited tradition in Spain; however, it is gaining increasing prominence as policies strongly favor the deinstitutionalization of children deprived of parental care. While foster care is fundamentally grounded in the principle of voluntariness, the growing difficulty in recruiting foster families—particularly for children with specific needs—has prompted the development of specialized foster care schemes, whereby foster carers receive financial compensation for their role. This paper examines the dispersed and fragmented statutory and regional frameworks governing this matter and explores the feasibility of establishing a regulatory framework to govern the legal relationship between the foster carer and the contracting entity, whether public or private.
