Abstract
This article offers a critical review of the consequences arising from dismissal declared null and void, namely the reinstatement of the employee and the payment of wages accrued during the proceedings, highlighting how the conditions imposed by legislation and case law restrict the actual effectiveness of such a legal classification. The imposition of mandatory reinstatement, which in some cases proves unwanted or even unfeasible, together with a restrictive judicial interpretation regarding the accrual of wages not received, hinders effective restitution and redress for the affected worker. This issue acquires relevance given that the grounds for nullity, whether expressly or implicitly, are linked to a violation of fundamental rights, with special attention to sex- or gender-related reasons. Consequently, proposals are developed to strengthen the necessary legal consequences to achieve an effective and adequate response to dismissal nullity.
