Abstract

The approval of law 39/2006, dated 14 December (Official State Gazette no. 299, 15 December), regarding the promotion of personal autonomy and care for people in situations of dependency is an event of great importance, given that it will deal with regulating what is called the «fourth pillar of the Welfare State» (provided that it is accepted that the other three pillars are social security, health and education). For the author, is a law with great and far-reaching objectives (universality, transversality, fairness, equality, etc.) with a long road ahead, in which many of its contents are left pending their later statutory regulation; these objectives must be fulfilled by means of the recognition of a «subjective right of citizenship», whose result will be the provision of services of a public, universal and non-discriminatory nature, integrated into the social services of the Autonomous Communities.
