Abstract
The aging of the population and the natural and gradual decline in the health of elderly people has led us to develop regulations and instruments allowing us to provide better living conditions for dependent people by means of the state and public institutions. Law 39/2006, dated 14 December, in its seventh additional provision, considers the future modifications necessary for regulating the private cover for situations of dependency which is already supplied in different countries in Europe. In this work, we relate the provision of dependency to the concepts and levels which could be guaranteed by means of a pension scheme, as pension schemes and insurance companies have a long tradition of designing different products whose purpose is to guarantee the payment of pensions or capitals after the policy holder or participant agrees to such a situation.
