Abstract
Starting from the theoretical irrelevance of the gender of the worker with regard to protection under the Spanish social security system, this work analyzes the different grounds on which there still nonetheless exists material discrimination deriving from the existence of norms which, although stated in neutral terms, are to a greater extent detrimental to women, in addition to positive measures which have been arbitrated both from a jurisprudential and regulatory standpoint to eliminate them.
