Abstract

This is an analysis of the significance of the disentailment of communal properties, reviewing some of the conclusions that have been defended for decades from the point of view of History of Law and Administrative Law, situating that disentailment within the social and economic reality of communal property not only as from the enactment of liberal legislation, but also beforehand, as it is clear that a simple study of Law is not enough to fully understand this process.
