Abstract

This article's main objective is to address the issue of collective bargaining through trade union sections, as part of the essential content of the fundamental right of freedom to form and join a trade union. To achieve this aim, a legislative and case-law analysis which is based on some examples of problems resulting from this kind of issue has been made. This analysis will be related with information and trade union control rights. From the above, it is concluded that there is a need to foster the trade union control of enterprises using collective bargaining. In order to analyse these effects, a number of different proposals have been shown.
