Abstract

The aim of this paper is to study the new parental leave introduced in art. 48 bis ET in order to transpose the Directive 2019/1158/EU on this matter. Thus, firstly, it refers to the evolution of the regulation of parental leave in EU Law. Secondly, it is studied its regulation in Spanish Law, analyzing, from a critical point of view, the characteristics of this leave, highlighting its positive and negative aspects in order to promote co-responsibility, as well as the interpretative problems that it could pose in practice. It should be pointed out that it has been regulated as a leave without compensation, despite the Directive provides that it must be compensated, at least in part, which could hinder the goal of achieving a balance sharing of family care responsibilities between women and men.
