Social concertation in Spain. A retrospective from the Workers' Statute to the present day regarding the working day

Abstract
Organic Law 11/1985, of August 2, on Freedom of Association provides that “Without prejudice to what is established by collective agreement, the Trade Union Sections of the most representative unions and those that have representation in the works councils and in the representative bodies that are established in the Public Administrations or have staff delegates, will have the following rights: b) To collective bargaining, in the terms established in their specific legislation” (art. eighth)
One of the elements that characterize flexibilization is the empowerment as a normative source of labor relations of the agreement of unions and employers, through the collective agreement with the objective of articulating and harmonizing the labor provision of workers in the company with the greatest efficiency in the production process.
Precisely, labor law in Spain has been evolving from a rigidity, imposed by pre-constitutional Labor Ordinances, to a progressive flexibility that, among other things, has been giving greater prominence to collective bargaining, enhancing decision-making between employers and workers. In fact, it has been the legislator who has been strengthening this position of the agreement throughout the successive reforms of the Workers' Statute and contributing to this with the law of the European Union itself, as an integral part of our legal system.
The aim of this modest contribution lies in showing, turning to an institution that today is subject to an intense debate, how it has evolved, with the invaluable contribution of collective agreements and therefore of the social concert, with greater or lesser intervention of the public powers.
Paradoxically, this relevance of the pact between workers and employers has not been possible in the establishment of the new working day, which at this time has begun the journey for its enshrinement as law, applicable back in January 2026.
