Effects of permanent disability on the employment contract: problems in applying the new article 49.1.n) of the labour law

Abstract
This paper analyses the reform of Article 49.1(n) of the Spanish Workers’ Statute, introduced by Law 2/2025, from the perspective of the right to equality and non-discrimination of persons with disabilities. It examines the consistency of the new termination regime with the constitutional, European and international frameworks for disability protection, and criticizes the reform for its disconnection from practical reality, its lack of systematic coherence, and the ambiguity in defining the adaptation procedure. The article argues that the reform fails to develop a comprehensive model for managing disability within the employment relationship. Accordingly, it is proposed that the new provision should be reinterpreted considering the principle of equality and non-discrimination, establishing reasonable accommodation and job retention as the general rule, and contract termination as a strictly justified exception.
