Abstract
The health and safety of the female worker who is pregnant, has recently had a baby or is breastfeeding has been a question that has been tackled late in the day in Spain, is moving slowly and suffers legal shortcomings, and which has failed to fully take on board the commitments as set out by the 92/85/CE Directive. This situation has left Spanish female workers in an unjustified and alarming situation with regard to lack of legal protection for a long time now. The protective content covered by the EU directive referred to above has just been incorporated into Spanish law after a fifteen-year wait. This work constitutes a detailed analysis of section 26 of the Law governing the Prevention of Risks at Work (LPRL) and its implications in other regulations governing the workplace and social security. It describes the current updated legal system featuring the most recent jurisprudential criteria in terms of the protection of health and safety of the female worker who is pregnant, has recently had a baby or is breastfeeding, their rights with regard to social security and the system of liabilities to which an employer who fails to comply with the above is duty bound.
