The victims of Francoism in the "Argentina Criminal Complaint": struggles for recognition and new inequalities

Abstract
This paper critically examines the construction of a subjectivity form, "the victim of Francoism", through a specific case, the so-called "Argentinian Criminal Complaint against Franco's crimes", the "Querella". This lawsuit, filed in 2010, is the only case opened in the World to prosecute Franco's crimes and it is based on the principle of universal jurisdiction. Through the analysis of the empirical material of a fieldwork (observations and interviews) conducted during 2014 and 2015 in Spanish local platforms supporting the "Querella", the paper analyses the ways in which the interpretative frame of human rights and its devices have been incorporated and re-appropriated by the plaintiffs. The international circulation of categories such as "victim" or "human rights" affects the subjectification processes of "the victim of Francoism" in contemporary Spain. This construction is addressed in this text from an anthropological perspective.
