Legal qualification of the prolonged maintenance of employment relationships in administrative regime: administrative contracts in Navarra

Abstract
This article addresses the legal qualification that should be given to the prolonged maintenance of employment relationships under administrative regime, based on the specific case of Public Administrations of Navarra. It explores how courts of Navarre initially dealt with these situations, qualifying the extension of such relationships as labour law fraud until the Supreme Court ruling of January 11, 2024, which rejected this position. The article discusses the concepts of fraud of law and abuse of rights, atypical offences that come into play due to the lack of specific regulation for this irregular act. We triangulate the classification that should be given to this act by examining three potential frameworks: labor law fraud, administrative law fraud, and abuse of rights. The goal is to offer a de sententia ferenda proposition that enables the correct legal qualification of maintaining an administrative relationship over an extended period, fostering a debate on the appropriate legal consequences.
