This paper scrutinizes the Judgment of the Spanish Constitutional Court 11/2023, dated February 23, which determines the adherence to the Constitution of health actions following the compelled hospitalization of a post-term pregnant woman whose wish was to give birth at home, attended by privately engaged midwives. Notwithstanding the foregoing, the delivery ended up taking place in a hospital and via cesarean section at the Central University Hospital of Asturias.
