This article examines the historical evolution, legal foundations, and current challenges of Patent Law, with special attention to Spain’s Patent Law 24/2015 and its articulation with international treaties such as the Munich Convention and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). It addresses the role of the patent system as a driver of technological innovation and its balance with public interest, particularly in the pharmaceutical sector. The study uses doctrinal and jurisprudential methodology with an analytical and comparative approach.
