Abstract
The level of primary education in Spain dragged, at least until 1970, a series of structural defects due largely to the legal regulations that, although initiated before the 1st. Restoration, would be fully developed during that period.
These defects affected at least the transition between the end of compulsory schooling and the beginning of working life or the continuity of studies, the introduction of the Graduate School, the continuity of the curricula and the different prescription of subjects for boys and girls.
Based on a careful analysis of the corresponding regulations, we extract some undesirable consequences of its development in the school practice.
